I was in an accident three weeks ago. It was the other car's fault. There were no injuries. We didn't call the police, but I got a written statement from the other driver admitting fault. I got her car and insurance information and filed a claim with her insurance. They sent an appraiser and I got an estimate for the damages. So all that is left now is for the insurance to approve the estimate and send me a check. I have called the insurance company almost everyday since I got the appraisal (about 2 weeks ago) and they are saying that they are waiting to get in touch with the policy holder; apparently they don't have her correct phone number. But they have the signed statement from her admitting fault. The agent in charge of my claim doesn't even pick up the phone or return my calls, I just talk to the operator who can't really give me any answers. I have the basic car insurance, I don't have collision coverage, so I haven't even called my own insurance. My car is operational but my rear susspension is gone, and the bent metal is hitting my tire; I really need my car rapaired asap. Should I call a lawyer even though there were no injuries? Man, Im screwed. A few years ago I let my insurance lapse on my vehichle and didnt hand the license plates in. The bite wasn't too serious, but it did break the skin so my neighbor went to urgent care to get bandaged up. We apologized and offered to pay any medical costs upfront, but my neighbor preferred to let our insurance companies handle the claim. My dog hasn't bit anyone in the past, and isn't considered a dangerous breed (labrador, border collie mix). We've let her off leash at the dog beach and dog parks with plenty of other dogs and people running around, and she hasn't shown any type of aggression. What I'm worried about is my insurance company dropping us from their coverage, and us subsequently having trouble finding homeowners insurance in the future. We tried convincing our neighbor to let us settle without getting the insurance companies involved, and explained the situation, but with no luck. Does anyone have any answers or advice about the whole situation? Should I make a claim first and let our insurance company know, or should I just sit and wait for the whole situation to play out? Lady friend totaled my car... How will my insurance go about covering things?

My friend borrowed my car & crashed into someone. She totaled my car (I got the car 6 months ago & I have $8150 worth of payments left on it) & did about $2000 worth of damage to the other car... She was in the hospital for 3 nights HOWEVER I believe she was kept for that long because of some other health issue she was having that was not caused by the accident. She's NOT going to pursue my insurance for medical coverage. She does not have a vehicle or vehicle or vehicle insurance. The other driver was not admitted to the hospital, I don't believe. We have the same insurance company. My friend was 4 times the legal alcohol limit when she was checked at the hospital following being taken there in an ambulance; however she was never checked by a police officer & issued a DUI. She was only issued a ticket for rear ending another vehicle... It goes without saying I am furious with her. I don't believe we will be in too much contact from this point forward unless everything works out good with this situation. Do I have much to worry about the hospital checking her BAC? I have heard that the only way the insurance company will find out all that is if it's in the police report. How will things be handled? I will sue my friend as a last resort; however she has NOTHING literally. I live in Florida.
